Typically, follow-up OSHA inspections don’t occur frequently, but the new policy changed all of that. The main focus is on “high-gravity” violators. Companies that have received “high gravity” willful violations, repeat violations, failure-to-abate notices, repeat violations at the originating establishment or serious willful violations that caused death are being inspected repeatedly.

How Will OSHA Inspections Impact Your Workplace?
Five specific areas regarding workplace healthy and safety policies will be strengthened: follow-up inspections, programmed inspections, public awareness, settlements and federal court enforcement. Follow-up inspections will take place at the workplace. Inspectors may also investigate additional work sites to make sure that previously cited violations have been corrected. A copy of the citation notification and any penalties assessed will be sent to the employer’s corporate headquarters. And, OSHA will continue to issue press releases on it's enforcement actions.

Settlements will include any or all of the following:

  • Employers may be required to hire consultants to develop new workplace health and safety procedures.
  • The agreement may be applied corporate-wide.
  • Employers may be required to consent to a court enforcement order.
  • Under Section 11(b) of the OSH Act, OSHA may appeal to the federal courts to ensure that citations are enforced, especially for companies that repeatedly refuse to make changes.
  • If an employer remains noncompliant, OSHA will seek contempt of court sanctions.

    Employers will also be required to report serious injuries or illnesses that require outside medical attention. OSHA may ask employers to consent to inspections based on those reports.
