The ADA and Workers with Cancer

There’s a new question-and-answer document on how the Americans with Disabilities Act (ADA) applies to employment rights of persons with cancer. The guidance was issued by the U.S. Equal Employment Opportunity Commission.

Approximately 40% of the more than 1 million Americans diagnosed each year with cancer are working-age adults. According to the EEOC, people with cancer experience discrimination at work based on old stereotypes and unfounded fears. Significant advances in detection and treatment mean that cancer is no longer the "death sentence" it used to be, the EEOC noted.

The new Q-and-A document addresses such topics as:

  • When cancer is a disability under the ADA
  • When an employer may ask an applicant or employee questions about cancer
  • What types of reasonable accommodations employees with cancer may need
